A public auction of the entirety will be auctioned first at the property located at the junction of Denio Road and Comerford Dam Road in the Town of Barnet, Vermont.
A public auction consisting of four separate parcels at the property located at the junction of Denio Road and Comerford Dam Road in the Town of Barnet, Vermont.
In the event that the entirety achieves a higher aggregate purchase price than the four separate sales then the entirety will be sold to the higher bidder.
Property description: Being land only, estimated to contain 459 acres, more or less, located in the Town of Barnet, Vermont; and being all and the same lands and premises conveyed to James S. Kendall by (1) Warranty Deed of Marvin R. Kendall dated August 13, 1997 and recorded in Book 97 at Page 36 of the Barnet Land Records; (2) Warranty Deed of Marvin R. Kendall dated August 13, 1997 and recorded in Book 97 at Page 37 of the Barnet Land Records; and (3) Warranty Deed of Marvin R. Kendall dated March 26, 1997 and recorded in Book 96 at Page 72 of the Barnet Land Records.
The four parcels sold are described as follows and will be sold in the order they appear on the following List:
Parcel One said to contain 100 acres, more or less; (See Barnet Tax Map 10, Lot 1 and Tax Map 5, Lot 48) Parcel Two said to contain 162 acres, more or less. (See Barnet Tax Map 5, Lots 38 and 45) Parcel Three estimated to contain 163 acres, more or less; (See Barnet Tax Map 10, Lot 6 and Tax Map 5, Lot 44) Parcel Four estimated to contain 34 acres, more or less: (See Barnet Tax Map 10, Lot 5) TERMS: The highest bidder(s) will be required to pay a deposit of $10,000.00 in certified funds or by bank treasurer’s check at the time of the auction. The highest bidder(s) will be further required to pay by certified funds or bank treasurers within seven days of the date of the auction an additional deposit to make the total deposit equal to 10% of the auction bid(s). The highest bidder(s) will also be required to sign a Purchase and Sales Agreement at the time of the public sale.
RIGHT TO REDEEM: The Mortgagor James S. Kendall is entitled to redeem the property at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale. The defendants, United States of America shall have a further right to redeem the property within 120 days following the public sale if its lien has not been discharged prior to, or as a result of the public sale.
